The Mahomedan law is applied by Courts in India to Mahomedans not in all, but in some matters only. The power of Courts to apply Mahomedan law to Mahomedans is derived from and regulated p225 of the Constitution of India but mostly by Indian legislation. The rules of Mahomedan law that have been expressly directed to be applied to Mahomedans are to be applied except in so far as they have been altered or abolished by legislative enactment. Thus, the rules of the Mahomedan law of Inheritance are expressly directed to be applied to Mahomedans. One of those rules is that a Mahomedan renouncing the Mahomedan religion is to be excluded from inheritance. But this rule was abolished by the Freedom of Religion Act XXI of 1850.
